Not certain, but it really looks like a black backed woodpecker to me. They like to perch like the first photo shows. If the picture is lightened it should be easier to tell the species.

May also be a hairy woodpecker but I think the white patch on the back would be visible in at least one photo.

I like American Three-toed on the strength of the dark markings on the sides and some white on the back. I'd be willing to entertain Hairy x Am. Three-toed, though.
