Definitely Spotted - the location is coastal CA and the bird has lots of white spots on the upper parts. Well if you know it's a towhee, how did you rule out BHGR? First off, notice the shape, structure and behavior of the bird. That should be enough right there, but there is no also no rufous in the collar and the bird lacks any white patches in the base of the primaries and coverts.
