That was my thinking as well until I saw the lack of wingbars. It does appear to have a short tail.

I was going through old pics and found these and  I don't recall my thoughts at the times I took them, but  do think they are small.  The leaves in the first 2 are that of Live Oak and those are pretty small leaves.  I thought about Orange-crowned for the first.
