Hawk?

These hawks kick my butt, any help on IDing this bird would be appreciated.

Bird was seen this morning in Chapel Hill, NC.  It was perched fairly high in the tree and appeared to be having Sunday brunch, although I could tell what it might have been eating.  This was the best long range shot I could manage.

I'm liking the Merlin, one of the very blurry photos I got shows a very white throat on the bird.  I would also have described the bird as a bit smallish for a hawk.

It's not a hawk, it's a falcon. Hawks are in the Accipitriformes, while falcons are in the Falconiformes. They're not at all related. Note relative width of pale vs. dark tail bands. Note where wing tips fall relative to tail tip. Note eye color.
