Ferruginous hawk? Scaup?

Can this be a ferruginous hawk?  A local well-known birder tells me it cannot be a red tail or red shoulder.  I've seen it a couple times before but can never get a good photo as it's across a river.

Location is southern Nevada.  Thanks!

Lesser on the Scaup--small nail and peak on the back of the head.

I'll have to plead the fifth on the hawk on the grounds that it might incriminate me as an ignoramus.

1. Still looks good for a Western Dark-morph Red-tail. Ferruginous would lack the red tail (seen in your other picture), have a longer gape, etc.

2. Agreed with HamRHead on the male Lesser Scaup, due to the purple sheen, narrow nail, back-peaked head, and barring in the flanks.
